Class Action against Sirius XM Canada Inc. and Sirius XM Canada Holdings Inc.
Kugler Kandestin is pleased to announce that it has filed an Application for Authorization to Institute a Class Action against Sirius XM Canada Inc. and Sirius XM Canada Holdings Inc., on behalf of all Quebec consumers of the satellite radio provider. The Application alleges that Sirius XM unlawfully increased customers’ subscription fees without providing proper notice, as required by the Consumer Protection Act. The class action seeks a Judgment condemning Sirius XM to reimburse customers the unlawful increases in subscription fees since September 1, 2013, which are currently estimated to be $100 million, in addition to punitive damages.
The Petitioner seeking to represent the class in this class action is Union des Consommateurs, a not-for-profit consumer association which is devoted to the protection and advancement of the rights of Quebec consumers.
