Tobacco Class Actions: Létourneau and CQTS v. Impérial Tobacco Canada Ltd et al
Kugler Kandestin, in collaboration with three other law firms, is actively involved in two class actions which were instituted in 1998 against the three largest Canadian tobacco manufacturers, Imperial Tobacco Canada Ltd., Rothmans Benson & Hedges Inc. and JTI-McDonald Corp. Following a trial which lasted more than two and a half years, the Honourable Mr. Justice Riordan of the Superior Court of Quebec rendered a historic judgment condemning the tobacco manufacturers to pay, solidarily, over $15 billion to tobacco victims. This is the highest monetary award ever granted in Canada. A copy of the judgment can be found here. A summary of the judgment can be found on page 9. The tobacco companies appealed from the decision of the Superior Court of Quebec and the appeal is scheduled to be heard in the Fall of 2016.
In a historic judgment rendered on October 27, 2015, a judge of the Quebec Court of Appeal ordered two of the tobacco companies to post $984 million in security for costs pending their appeal.
