Settlement Agreement reached in the class action concerning the bridge serving the A-25 highway: Union des consommateurs v. Concession A25, s.e.c. and the Attorney General of Québec.

On May 20, 2016, the Court rendered a Judgment approving the Out of Court Settlement Agreement reached between the parties.

Members who must complete a Claims Form pursuant to this Settlement, have until August 28, 2016 to complete said form and return it online.

Background of the file

Pierre Boivin and Alexandre Brosseau-Wery represent the Union des consommateurs and the representative Plaintiff, Jean-Pierre Drevillon in a class action filed in the name of individuals which were charged administrative fees after having driven on the bridge of Autoroute A-25 without a transponder or client account. The class action alleges that there was no mention of these fees on the highway and that the members of the class have the right to be compensated for the fees which they were unjustly charged.

On January 21, 2013, the Superior Court of Québec rendered a judgment authorizing the filing of the class action.

On February 29, 2016, the Union des Consommateurs, represented by Kugler Kandestin, finalized a Settlement Agreement with Concession A25, s.e.c. and the Attorney General of Québec.

The settlement affects all individuals whose vehicle drove on the A25 bridge between May 21, 2011 (date at which the bridge was opened to the public) and April 30, 2013 inclusively and to whom Concession A25 s.e.c. (A25) invoiced administration fees which were paid as a result of the fact that their vehicle was not equipped with a transponder registered with A25 and that they did not have a client account (provided that these people did not already benefit from a credit at the opening of the client account for administration fees to be paid, or they did not already have a client account with eligible Transits) (hereinafter the « Group »).
