Court authorizes class action concerning Expedia.ca, Hotels.com and Travelscape.ca websites

We are pleased to report that Justice Chantal Lamarche of the Superior Court of Quebec has granted the Application for authorization to institute a class action that we are advancing on behalf of all Quebec consumers who have made a hotel reservation via one of the Expedia.ca, Hotels.com or Travelscape.ca websites since January 10, 2015 and who have had to pay hotel fees in addition to the total hotel room reservation price. The Application alleges that the Defendants failed to comply with several rules of public order in the Consumer Protection Act and in the Regulation respecting travel agents, including those relating to misleading advertising and to the duty to display a total price including these hotel fees

You are a member of the class if you meet the following definition:

All Quebec consumers who have made a hotel reservation via one of the following websites, namely Expedia.ca, Hotels.com or Travelocity.ca, and which mandatorily had to disburse, in order to secure their reservation, an additional amount to the total price displayed at the time of the reservation (notably for fees commonly referred to as “hotel fees”, “establishment fees” or “resort fees”), since January 10, 2015 [Translation]

Following this judgment, Kugler Kandestin will shortly file in Court the authorized class action against the defendants identified in said judgment, namely Expedia Inc., Hotels.com LP, Travelscape LLC, Corporation Expedia Canada and Tour East Holidays (Canada) Inc.
