Superior Court of Quebec authorizes Class Action in connection with sexual abuse committed by Phillip (Hart) Baugniet while he was a director or teacher at Lachine High School, Victoria School or F.A.C.E. School

Kugler Kandestin is pleased to announce that by Judgment dated June 27, 2024, the Superior Court of Quebec authorized the institution of a class action against Phillip (Hart) Baugniet and the English Montreal School Board.
Kugler Kandestin will file a class action lawsuit as soon as possible against the defendants claiming compensatory damages for each victim, as well as punitive and exemplary damages of $15 million.
The class action has been authorized for the benefit of the following group of people:
“All persons who, while minors, were sexually abused by Phillip (Hart) Baugniet, which sexual assaults were caused in connection with and while he was the principal of Lachine High School, Victoria School, or FACE School, in Montreal, or held a teaching, management or supervisory position at such schools, as well as the succession of such persons if deceased since August 21, 2019″

Following a judgment rendered on September 28, 2023, Kugler Kandestin filed a Modified Application for Authorization to Institute a Class Action on behalf of all persons who were, as minors, sexually abused by Philip Baugniet while he was the director and/or teacher at Lachine High School, F.A.C.E. School and Victoria School in Montreal.
The hearing on the Modified Application for Authorization will be taking place on March 26, 2024, at the Montreal Courthouse.
The class action is for the benefit of the following group of people:
“All persons sexually assaulted as minors by Phillip (Hart) Baugniet while he was principal of the Lachine High School, Victoria School or F.A.C.E. School in Montreal, or held a teaching, executive or supervisory position in these schools, as well as the estates of such persons if deceased since August 21, 2019″
The Application alleges that the English-Montreal School Board is liable, together with Philip Baugniet, for the damages suffered by class members.

Kugler Kandestin filed today an Application for Authorization to Institute a Class Action on behalf of all persons who were, as minors, sexually abused by Philip Baugniet while he was the director and a teacher at F.A.C.E. School and Victoria School in Montreal.
The class action is for the benefit of the following group of people:
“All persons sexually assaulted as minors by Phillip (Hart) Baugniet while he was principal of the Victoria School or F.A.C.E. School in Montreal, or held a teaching, executive or supervisory position there, as well as the estates of such persons if deceased since August 21, 2019″
The Application maintains that the Centre de services Scolaires de Montréal and the English-Montreal School Board are liable with Philip Baugniet for the damages suffered by class members.
