Settlement agreement for Victims of sexual abuse committed by Frère Jean-Paul Thibault approved by the court

February 2016

Kugler Kandestin is pleased to announce that the Honourable Michel A. Pinsonnault, judge of the Superior Court of Quebec, approved a settlement of the class action instituted on behalf of victims of sexual abuse committed by Jean-Paul Thibault while he was affiliated with Collège St-Hilaire.

Pursuant to the Judgment approving the settlement, victims of Frère Thibault are eligible to receive a minimum of between $55,000 and $110,000 net as compensation. Furthermore, the settlement agreement prohibits Mr. Thibault or any of the Respondents from knowing the names of the victims who make claims, and nobody will have the right to contest any victim’s claim.

Claims must be made no later than July 5, 2016, failing which victims will lose their rights. All people who were victims of sexual abuse or who know of people who were victims are strongly encouraged to contact Robert Kugler free of charge, in order that we may inform you of your rights and assist you. Your name and information will be kept strictly confidential.

Members who wish to submit a claim must do so by sending a claim form to the Honourable André Forget, Adjudicator, on a confidential basis, by no later than July 5, 2016:

Failure to submit one’s claim by the deadline (July 5, 2016) will result in the forfeiture of any right to benefit from the Settlement Agreement.

Kugler Kandestin is pleased to announce a settlement of the class action instituted on behalf of victims of sexual abuse committed by Jean-Paul Thibault while he was affiliated with Collège St-Hilaire. The settlement agreement requires Court approval. The Hearing of the Application to approve the settlement agreement will take place February 1, 2016, at the Montreal Court House, in room 15.07, at 10:00 am.

If the settlement agreement is approved, victims of Frère Thibault will be eligible to receive as much as $110,000 in compensation. The settlement agreement prohibits Mr. Thibault or any of the Respondents from knowing the names of the victims who make claims, and nobody will have the right to contest any victim’s claim.

Robert Kugler are acting on behalf of the Petitioner with respect to a Motion for Authorization to Institute a Class Action against Frère Jean-Paul Thibault, Collège St-Hilaire and the religious order, l’Institut des Frères de Notre-Dame de Miséricorde, on behalf of individuals who were sexually abused.

The victims are entitled to use a pseudonym so that their names and identities are kept confidential.
