Class Action Against FedEx for Unlawful Customs Duties and Processing Fees
Update: February 2, 2026 – Counsel to Seek Approval of Settlement Agreement
We are pleased to announce that the parties in this class action have reached an out-of-Court settlement. The Settlement Agreement provides that while FedEx already reimbursed class members, directly or indirectly, the duties and fees wrongly assessed in violation of CETA during the class period (as set out therein), they have agreed, without admission, to pay an additional amount to be remitted to the Make-a-Wish Foundation. The payment of class counsel’s legal fees, which must be approved by the Court, shall be deducted from such additional amount.
The settlement is subject to the approval of the Superior Court of Québec. The hearing to approve the settlement will be heard on May 6, 2026, at the Montreal Courthouse. At that hearing, class counsel will also ask that the Court approve their fees.

By judgment dated December 20, 2018, the Superior Court of Québec authorized the institution of a class action against Federal Express Canada Corporation (“FedEx”) on behalf of Québec consumers and legal persons who, from September 21, 2017 until December 20, 2018, were charged and paid customs duties and/or processing fees collected by FedEx in respect of the import of any goods originating from a European Union Country or a beneficiary of the Canada-European Union Comprehensive Economic and Trade Agreement (known as “CETA”).
FedEx’s appeal of the authorization judgment was dismissed by judgment of the Court of Appeal dated November 11, 2019 (rectified on November 14, 2019).
Following the authorization judgment, a class action lawsuit was filed alleging that FedEx illegally collected from Québec customers and legal persons customs duties and/or processing fees in respect of the import of any goods originating from a European Union Country or a beneficiary of the CETA between September 21, 2017, until December 20, 2018.
The class action seeks the reimbursement of the customs duties/processing fees unlawfully collected, in addition to punitive and exemplary damages.
