Settlement of Class Action Against SiriusXM Canada Inc.

Update: December 20, 2024 – Payment to Class Members by Cheque

We are pleased to confirm that members of the class action against SiriusXM (SXM) who were unable to accept and/or deposit the settlement funds sent to them on or around March 13, 2024 before they expired will be receiving these funds by cheque.

The cheques will be placed in the mail by December 23, 2024. Due to the disruption of Canada Post services and the holiday season, delivery times may be longer than usual.

Class members who receive a cheque will have six (6) months from the date indicated on the cheque to deposit it, after which it will no longer be valid.

Update: November 7, 2023 - Judgment Approving Settlement of Class Action

Kugler Kandestin is pleased to announce that on November 7, 2023, the Superior Court of Québec rendered a judgment approving a $22 million settlement in the class action against Sirius XM Canada Inc (“SXM”).

This settlement benefits all persons who meet the following definition of the Class:

“All persons in Quebec who entered into subscription contracts for satellite radio or Internet radio services provided by Sirius XM Canada Inc. and whose subscription fees were unilaterally increased by Sirius XM Canada Inc. since September 1, 2013 without sufficient notice.”

This settlement allows for compensation for anyone whose subscription fees were increased between September 1, 2013 and September 22, 2018, even if they are no longer subscribed to SiriusXM today.

Next steps

Class members do not have to take any steps to become a member of this class action or to receive compensation. By December 19, 2023, Class members will receive a notice from SXM informing them of the amount of compensation they are entitled to receive, as calculated by the experts based on the alleged unilateral increases in their subscription fees charged by SXM between September 1, 2013 and September 22, 2018.

This amount will be paid to Class members by March 15, 2024.

The notice will also invite members to contact the claims administrator, RicePoint, if necessary, to correct or validate certain information, such as member address and preferred payment method, etc.

Update: November 3, 2023 - Settlement to be Submitted for Court Approval

We are pleased to report that on the eve of trial, the parties to this class action reached an out-of-Court settlement. Under the settlement, Sirius XM Canada Inc. will pay $22 million plus various expert costs, notice costs, and claims administration costs.

The settlement must be approved by the Court in order to be valid. On November 3, 2023, the parties will seek approval of the settlement, which they strongly recommend. If the settlement is approved, individuals who meet the definition of the Class will receive compensation without the need to submit a claim.

The settlement was entered into by Sirius XM Canada Inc. without admission of fault, wrongdoing or liability.

Update: March 27, 2018 – Court Authorizes Filing of Class Action

By judgment dated March 27, 2018, the Superior Court of Québec authorized the filing of a class action against SiriusXM Canada inc. (“Sirius XM”) on behalf of Québec consumers of the satellite radio and internet service provider.

Sirius XM’s permission to appeal the authorization judgment was denied by judgment dated June 15, 2018.

Following the authorization judgment, a class action lawsuit was filed alleging that SiriusXM illegally increased users’ subscription fees without proper notice, in breach of the Consumer Protection Act.  The class action seeks the reimbursement of the unlawful increases in fees between September 1, 2013 and September 22, 2018, in addition to punitive and exemplary damages.

Union des consommateurs, a not-for-profit association dedicated to the protection and promotion of the rights of Québec consumers, obtained the status of representative of the class.
