Kugler Kandestin files a class action against Expedia, Inc., Corporation Expedia Canada, Hotels.com LP, Travelscape LLC and Tour East Holidays (Canada) Inc.

On January 10, 2018, Kugler Kandestin filed an Application for authorization to institute a class action on behalf of Quebec consumers who reserved a hotel room via Expedia.ca, Hotels.com or Travelocity.ca, and who were required to pay, in order to secure their reservation, an additional amount above the total price displayed at the time of the reservation (namely for fees commonly referred to as “hotel fees”, “establishment fees” or “resort fees”), since January 10, 2015.

The Application alleges that the Defendants failed to respect numerous rules of public order in the Consumer Protection Act and the Regulation respecting travel agents, including rules relating to misleading advertising and the obligation to display a total price including the hotel fees in question.

The Application seeks the reimbursement of the hotel fees paid above the total displayed price, after January 10, 2015, as well as exemplary damages.
