Court authorizes Class Action Against Sirius XM Canada Inc.
By judgment dated March 27, 2018, the Superior Court of Quebec authorized the institution of a class action against Sirius XM Canada inc. (“Sirius XM”) on behalf of Quebec consumers of the satellite radio and internet service provider.
Sirius XM’s permission to appeal the authorization judgment was denied by judgment dated June 15, 2018.
Following the authorization judgment, a class action lawsuit was filed alleging that Sirius XM illegally increased users’ subscription fees without proper notice, in breach of the Consumer Protection Act. The class action seeks the reimbursement of the unlawful increases in fees between September 1, 2013 and September 22, 2018, in addition to punitive and exemplary damages.
Union des consommateurs, a not-for-profit association dedicated to the protection and promotion of the rights of Quebec consumers, obtained the status of representative of the class.
If you are, or have ever been, a subscriber of Sirius XM at any time between September 1, 2013 and September 22, 2018, Sirius XM likely increased your subscription fees in a manner that we consider to be unlawful. We would be pleased to discuss your situation with you, free of charge, in order to inform you of your rights in this matter. You may communicate with Robert Kugler, Pierre Boivin or William Colish, the attorneys responsible for this class action, at 514-878-2861, or at rkugler@kklex.com, pboivin@kklex.com or wcolish@kklex.com.
