Settlement in the Class Action against Symantec approved by Quebec and Ontario Courts

We are pleased to announce that on February 29, 2024, the Honourable Justice Dominique Poulin of the Superior Court of Quebec approved the Settlement reached by the parties, the value of which is estimated by class counsels at over $30 million. The Settlement was reached with defendant Symantec, now known as Gen Digital Inc. 

To bind the parties, the Settlement also had to be approved by an Ontario court, and this was done on May 6, 2024. 

As a result, the Settlement is now enforceable, and members who have not previously opted out of this class action will be eligible for compensation.

In Quebec, these members are:

“All natural persons who resided in Quebec at the time they purchased and/or obtained a license allowing them to use, for non-commercial purposes, any of the following products: Norton™ Antivirus, Norton™ Internet Security, Norton™ Security, Norton™ Security with Backup, Norton 360™, or Norton™ One (hereinafter, collectively, the “Norton Products“), at any time between July 24, 2010 and June 27, 2016.”

A Notice to members was published in certain newspapers on May 31, 2024. For members for whom Gen Digital Inc. still had contact information, this Notice was also sent by email directly by the Claims administrator, Ricepoint.

Class Action Settlement to be Submitted for Court Approval on February 28, 2024

We are pleased to announce that shortly before the trial was set to begin in the fall of 2023, the parties to this class action concluded an out-of-Court settlement. This settlement aims to settle the present class action and a similar one instituted in Ontario. The settlement is valued at more than 30 million dollars.

The settlement must be approved by the Court in order to be valid. On February 28, 2024, the parties will seek approval of the settlement for the Québec Class Members, which they strongly recommend. If the settlement is approved, individuals who meet the definition of the Class set out below and who have not already excluded themselves will receive compensation as per the modalities indicated in the settlement:

“ All natural persons resident in Quebec at the time they purchased and/or licensed, for purposes other than their business, any of the following products: Norton™ Antivirus, Norton™ Internet Security, Norton™ Security, Norton™ Security with Backup, Norton 360™ or Norton™ One (the “Norton Products”), at any time between July 24, 2010 and June 27, 2016.”

The settlement was entered into by Symantec (now Digital Inc.) without admission of fault, wrongdoing or liability.

We are pleased to announce that, by judgment dated April 16, 2019, Judge François P. Duprat of the Superior Court of Quebec granted the Re-amended motion for authorization to file a class action that we filed on behalf of all Quebec consumers who purchased and/or licensed certain Norton products. You can consult the Notice to class members which was authorized by the Court and the Originating Application that we filed.

 The Application alleges that the Norton products were defective and had design defects which rendered them unfit for the use for which they were intended and that Symantec made false and misleading representations with respect to these products. As a result, the class action seeks financial compensation for all Quebec consumers who purchased and/or licensed certain Norton products at any time between July 24, 2010 and June 27, 2016.

You are a member of the class action if you meet the following definition:

“All natural persons resident in Quebec at the time they purchased and/or licensed, for purposes other than their business, any of the following products: Norton™ Antivirus, Norton™ Internet Security, Norton™ Security, Norton™ Security with Backup, Norton 360™, or Norton™ One (collectively, the “Norton Products”) at any time between July 24, 2010 and June 27, 2016”

 Please note that if you meet the definition of a class member, you are automatically part of the class action and you do not need to take any steps to register. However, if you are a member of the class, we invite you to register on our list of class members so that we can update you when there are significant developments in this file.
